RESUMEN
Este texto aborda las relacione s entr e
la vi olenc ia y e l derec ho desd e u na
perspectiva cr ítica que cuestiona los
enfoques reduccionistas provenientes
de l a tradición liberal, así como de la
tradición marxista, que interpretan el
derecho desde un a lógica instrume ntal.
Retomando aportes de la teoría polít ica,
se pretende reconstruir las continu ida-
des que existe n entre estos conceptos
a par tir de l c oncept o de “esta do de
pode r s obera no, pero en fu nción de
analizar contextos contemporáneos y
poscoloniales a partir de nuevas for mas
Posteri ormente, se r etoma e l concep to
de fetich ismo legal como una forma de
comprender la fascinación y f uerza que
produce l a ley (dimen sión simbólica y
emocional de l derecho), aun cuando no
ha logrado neutralizar o excluir la violen-
cia de la vida social y el ocultam iento de
las relaciones de v iolencia.

ABSTRACT
This article addresses the relation-
ships b etween violence and law from a
critic al pers pective that questions the
reductionist approaches from the liberal
tradit ion, as well as from the m arxist
tradition, which interprets law from an
instrumental logic. Regarding the contri-
butions from politic al theory, the aim is
to reconstruct the continuities that exist
between these concepts from the concept
-
lem of sovereign power, but to analyze
contemporary and postcolonial contexts
based on new forms of statehood that are
of le gal feti shism is retaken as a way
of u nderstanding the fa scination and
force that the law produces (symbolic
and emot ional dimens ion of law), even
when it has not managed to neutral ize or
exclude violence from social life, and the
concealment of relationships of violence.
