RESUMEN
El Nuevo Constituc ionalismo Lat inoamericano (NCL) es uno de los
fenómenos más i nteresantes del De recho constituc ional comparado ac-
tual. Uno de sus ra sgos es la incorpora ción a las Constitucio nes de una
amplia car ta de instru mentos particip ativos que contiene las noved ades
de la democr acia participat iva, lo que convierte e stos textos en alguno s
de los más des arrollados del mundo en esta materia. La pregunta es si
esta inc orporación de i nstrumento s participat ivos mejora la democr acia
o la empeora, s i logra sus objetivos particip ativos o si la democr acia
partic ipativa acaba dilu ida en el modelo repre sentativo, o convertid a en
herram ienta en manos de gobernante s que desean for talecer s u poder
al debilit ar los otros poderes del Estado. ¿Produc e la democracia par-
ticipativa de l NCL una mejora o un empeora miento democrátic o? Este
artícu lo, mediante el método analíti co-sintét ico y media nte el estudio
comparado de l a doctrina y la l egislación má s relevante, trat a de aportar
una respue sta para conclui r que, si bien los instr umentos parti cipativos
son en sí neutros y de penderá de la voluntad d el actor que los active que
sean posit ivos o negativos, la democra cia participativa s upone la intro-
ducción de un a cuña de part icipación di recta en un mo delo esenci almente
represe ntativo, lo que puede ser fuente d e desequilibr ios.

ABSTRACT
The New Lati n American Co nstitutionali sm (NLAC) is one of the most
interesting phe nomena of the pre sent compared co nstitutional L aw. One
of its features is the inc orporation to the Con stitutions of a wid e carte of
participatory tool s that contain the l ast news of participa tory democracy
converting those texts i n some of the most developed on es in this area. Th e
question is if th is incorporation of partic ipatory tools improves democ racy
or worsens it, if ac hieves its particip atory objectives or if part icipatory
democracy en ds or diluted in the representativ e model or becoming a tool
in the hand s of rulers that want to stre ngthen their power wea kening the
other powers of the State. D oes the participatory de mocracy of the NLAC
make a demo cratic improvement or worsenin g? This paper, by the analyt-
ic-syntheti c method and through th e compared study of the most relevant
doctrine an d legislation, tries to gi ve an answer concludi ng that, although
the participator y tools themselves are neutra l and it will depend of the will
of the actor that active the m that they will be positive or negative, p artici-
patory democra cy means the introd uction of a direct particip ation wedge in
a essentially rep resentative model and can b e source of imbalances .
