Abstract
The purpose of this work is to study one of the most relevant
‘phenomena’ in contemporary legal science: constitutionalization of
private law. In this regard, this document presents a critique against
this phenomenon, departing from the philosophy of law, where
the three axes of the work are set out: (i) law; (ii) rights and their
understanding as legal principles; and (iii) the role of judges, leadi ng
to a practical analysis of how constitutionalization -very relevant in
Col ombia- has had a negative impact on pr ivate law, also emphasiz in g
on the advantages of a system based on rules provides.
