Resumen
Elderechointernacionalmantieneunarelacióninescindibleconelconflicto;siendo
elprimerolatesis,elsegundolaantítesis,ylasíntesiselejerciciodialécticoque
caracterizalasrelacionesentrelasnacionesdelmundoquebuscanserregladas
ypositivizadas.Laapariciónyelposteriorreconocimientodelterrorismocomo
unfenómenoqueatentagravementecontralapazylaseguridadinternacional
alertarona la sociedadinternacionalque, ante lamagnitudde sus efectos,
emprendió una lucha frontal contra este flagelo en distintos escenarios. Los
hechos del 11 de septiembre de 2001 indudablemente dieron nueva dimensión
alpapel del ConsejodeSeguridad de lasNacionesUnidas en lorelativo a la
agresiónyalempleodelafuerzaenelsupuestodelalegítimadefensa.Eneste
contexto se presenta la discusión sobre los efectos de dicha modificación, ya sea
en la vía evolutiva de un derecho internacional esencialmente dinámico o en una
involucióndelmismoen lamedidaenqueesteórganoentendióquelosactos
terroristasprovenientesdeunsujetoactivoindeterminadoconstituyenactosde
agresión,sinimportarqueésteseaunactornoestatal.

Abstract
InternationalLaw hasa closerelation withthe conflict;being thefirst onethe
thesis, the second one its antithesis, and the synthesis, the dialectic exercise that
characterizesrelationsamongthenationsoftheworldwhichseektoberegulated.
Theemergence andlater acknowledgmentof terrorismas a phenomenonthat
attempts against international peace and security, alerted the International Society,
which,beforethemagnitudeofitsconsequences,initiatedafrontalfightagainst
thisscourge.The eventsthat tookplace onSeptember 11,2001, undoubtedly
reshaped the role of the Security Council of the United Nations in relation to
both the concept of aggression and the legitimate use of force. In this context, an
importantdiscussionappears,andisrelatedtotheeffectsofthattransformation;
eitherontheevolutionarywayofanessentialdynamicinternationallaworinits
involution in the sense that the Security Council understood that terrorist acts
perpetratedby an undetermined actorconstitute acts of aggression,whether
being an State or not state agent
