RESUMEN**
Las polémicas entre las Altas Cortes, a lo
largo del tiempo se han convertido en algo
muy frecuente y por lo tanto es común oír
el calicativo de “choque de trenes”; un
tema de gran trascendencia en el ámbito
del Derecho Administrativo, es lo relacio-
nado con la procedencia de las acciones de
nulidad y la de nulidad y restablecimiento
del derecho, sobre lo cual se despliega un
debate jurisprudencial entre la Honorable
Corte Constitucional y el Honorable Con-
sejo de Estado. Para observar lo anterior,
se hace necesario vericar los anteceden-
tes, y de esa forma, comprender los in-
convenientes que la “discordancia” podría
traer.
