RESUMEN
El presente docume nto de investigación
no pretende postul ar nuevas teoría s
acerca del total itarismo o del realismo
jurídico, pero sí qu iere mostrar u na
realidad que cre ce de manera constante
dentro del sistem a judicial y es cons pi-
cua con la vida cot idiana en el á mbito
jurídico colombiano. Nos re ferimos a la
realidad de los es trados judicia les y la
amplia disc recionalidad de los juece s que
conllevan la con strucción de una jus ticia
que ha desbordado el par adigma de lo
justo, al ser vicio de los senti mientos, el
yerro interpret ativo y las va nidades de
quienes encumbr an el poder, afectando
la dignidad de l ser humano al restri ngir
su libertad de manera preventi va cada
vez con mayor ligereza. De a lgún modo
este fenómeno se ha conver tido en el
leviatán de hoy, con profu nda incidencia
en pensam ientos de guerra de qu ienes
sufren los des manes de los jueces,
creando situac iones de descontento en
la población afect ada direct a e indirec-
tamente y const ruyendo sentim ientos
de antiderecho, cu ya génesis no es otr a
que el irrespeto q ue muestran los jueces
con sus decisiones por l a dignidad de
hombres y mujeres; desconociendo lo s
preceptos jurídico s de orden superior y
rompiendo la estrec ha conexión con los
derechos huma nos, en donde el respeto
por la dignid ad de las personas marca e l
derrotero de los demá s derechos como
el derecho a la libe rtad, al cu al le dare-
mos la mayor relevanc ia en el presente
artícu lo. Se pretende construir o ac uñar
un nuevo tér mino dentro de la losofía
político-jur ídica, “ totalitarismo jurí-
dico inve rtido”, que result a del aná lisis
histórico del dere cho, pasando por el
totalitar ismo invert ido, la amplia dis -
crecionalid ad concedida por el sis tema
judicial a los jueces y e l irrespeto por la
dignidad hum ana por par te del Estado,
que se evidencia en a lguna s decisiones
del sistema judic ial colombiano, las
cuales crecen de manera soter rada ale-
jándose de la senda del de recho.
Palabras clave: totalitarismo, real ismo

ABSTRACT
This rese arch document do es not pre-
tend to postulate ne w theories about
totalitar ianism or legal realism, but
it does want to show a real ity that is
constantly g rowing within the judic ial
system and cons picuous with daily life
in the Colombian lega l environment .
We refer to the realit y of the judicial
courts and t he wide discret ion of the
judges that leads to the con struction of
a justice that ha s exceeded the parad igm
of fairness, at t he service of fe elings,
interpretive e rror and the va nities of
those who ex alt power, aecting the
dignit y of man by restr icting hi s free-
dom in a preventive way more a nd more
lightly. Somehow th is phenomenon has
become the Lev iathan of today, with a
profound impact on thou ghts of war
of those who suer the excesses of t he
judges, creati ng situations of disconte nt
in the a ected population di rectly and
indirect ly, building feel ings of anti-
right, whose gene sis is not other th an
the disresp ect that judges show w ith
their decis ions for the dign ity of men
and women; ignorin g the legal precepts
of a higher order and breaking the close
connection wit h human rig hts, where
respect for the dignity of man marks the
course of other rig hts such as the right
to freedom, to which we w ill give t he
greatest relev ance withi n the present
document. It is inte nded to construc t
or coin a new term wit hin the polit-
ical-legal philosophy, “inverted legal
totalitar ianism”, which results from the
historica l analysis of t he law, passing
through inve rted totalit ariani sm, the
wide discret ion granted by the judicial
system to judges a nd the disresp ect
for human dig nity by the St ate that is
evidenced by some dec isions within t he
Colombian judicial s ystem which a re
growing unde rground, movi ng away
from the path of law.
